H-1B Lottery & Selection
Your employer files an H-1B petition on your behalf. USCIS runs a lottery in April — as of 2025, a weighted system gives priority to higher-wage positions. If selected, your petition is adjudicated and you receive an H-1B visa valid for 3 years.

- Receive approval notice (I-797) by October 1 start date
The lottery is not guaranteed — selection rates have been below 30% in recent years. Have a backup plan (e.g., OPT extension, L-1, O-1).
Employers with higher prevailing wage levels (Levels III and IV) have better lottery odds under the weighted system. Negotiate your salary accordingly.
